Kissimmee couple accuses insurance company of breach of contract

ORLANDO — A Kissimmee couple is suing an insurance company, alleging breach of contract.

Brian Colbert and Cindy Colbert filed a complaint Jan. 23 in Orange County Circuit Court against American Integrity Insurance Company of Florida, alleging the defendant failed to comply with its obligation to provide coverage for a property loss following a hurricane.

According to the complaint, on Sept. 11, 2017, the Colberts' home at 2134 Mallard Creek Circle, Kissimmee, suffered damages from Hurricane Irma. The Colberts said they notified the defendant of their dwelling's damage The couple said they have complied with all conditions precedent to entitle them to recover damages under the policy but they have not been paid fully of the losses as required by the insurance policy. 

The plaintiffs allege American Integrity Insurance has failed or refused to fully perform under the policy and failed to fully pay for all of the policy owners' losses as required by the insurance policy.

The Colberts seek trial by jury, damages of more than $15,000 plus interest on any overdue payments, attorney fees and court costs. They are represented by attorney Roger A. Hatfield of Morgan & Morgan PA in Orlando.
