Tourist blames Walt Disney resort for assault

ORLANDO — A Osceola County tourist is suing Walt Disney, alleging negligence in failing to provide a safe place for the use of the public.

Michael Nikitenko filed a complaint Jan. 23 in Orange County Circuit Court against Walt Disney Parks and Resorts U.S. Inc., alleging the defendant failed to reasonably care for the safety and protection of its guests.

According to the complaint, on Nov. 25, 2016, Nikitenko was at Disney Springs in Lake Buena Vista, Florida, where he was criminally, brutally and savagely assaulted and battered. As a result, Nikitenko says he suffered physical injuries, disability, mental pain and medical expenses. 

The plaintiff alleges Walt Disney Parks and Resorts failed to provide adequate security for the users, customers and invitees of its property.

Nikitenko seeks trial by jury, compensatory and punitive damages of more than $15,000, plus interest, costs of suit, attorney fees, and all other relief the court deems proper. He is represented by attorneys Craig R. Lynd, Jeffrey S. Kaufman and Ashley Lefevre of Kaufman & Lynd PLLC in Orlando.
