Home improvement business accuses Winter Park property owners of breach of contract

ORLANDO — An Orange County home improvement business is suing Winter Park property owners, alleging breach of contract, fraud and unjust enrichment.

DDD Empire LLC, doing business as 3D House & Home, filed a complaint Jan. 22 in Orange County Circuit Court against Aaron P. Mantzke and Elidalis R. Burgos, alleging they failed to pay for work completed. 

According to the complaint, in October 2017, 3D House & Home suffered economic harm because of the wrongful conduct of the defendants to report credit card charges. The suit says the charges were supposed to be paid to the plaintiff for materials and services received for home improvements such as landscaping, installing new windows, a deck and a roof and bathroom remodeling in exchange for $120,000. 

The plaintiff alleges Mantzke and Burgos breached the contract by failing to pay as promised, causing vendors to shut down 3D House's credit lines or account. The suit says the defendants disputed the validity of the charges as soon as the plaintiff's work was completed in an effort obtain goods and services for free.

The suit says the unpaid amount is $81,401.

3D House & Home seeks trial by jury, damages and interest, plus attorney fees and court costs and all other relief the court deems just. It is represented by attorney M. Jason O'Neal of Cornerstone Law Firm PLLC in Maitland.
