CLEARWATER — A shopper is suing Wal-Mart Stores East LP, alleging negligence.
Deborah S. Bailie filed a complaint on Jan. 23 in the Pinellas Circuit Court against Wal-Mart Stores East alleging that the retail store failed to use due care to maintain its premises in a safe condition.
According to the complaint, the plaintiff alleges that on Dec. 13, 201 she slipped and fell in a puddle of what appeared to be water near the produce section of the defendant's Dunedin store. As a result, she allegedy sustained serious injuries, suffered and will continue to suffer great physical pain and mental anguish, and has incurred expenses in an attempt to cure and/or treat the injuries she sustained.
The plaintiff holds Wal-Mart Stores East responsible because the defendant allegedly failed to inspect the premises for dangerous conditions and failed to warn the plaintiff of the dangerous condition.
The plaintiff requests a trial by jury; and seeks judgment against the defendant for monetary damages, including costs, and any other relief the court deems appropriate. She is represented by David A. Papa of Papa & Gipe PA in Clearwater.
