Widow sues doctors and Mease Countryside Hospital after husband dies

CLEARWATER — A widow is suing a number of local medical providers, alleging negligence, vicarious liability and wrongful death.

Vilma Woodard filed a complaint on Jan. 23, in the Pinellas Circuit Court against Beverly Encarnacion MD, Beverly Encarnacion MD PA and Trustees of Mease Hospital Inc., d/b/a Mease Countryside Hospital, alleging that they failed to exercise standard care and skill required of medical providers and facilities.

According to the complaint, the plaintiff alleges that on Sept. 20, 2016 her spouse was discharged from the hospital by the defendants on assumption that he was already stable after surgery. He died within hours after being sent home. As a result, the plaintiff suffered mental pain and suffering, and loss of decedent’s companionship, protection, support and services, and net accumulations. She also incurred medical, burial and funeral expenses. 

The plaintiff holds the defendants responsible because they allegedly failed to prescribe proper medication and treatment to the decedent and failed to prevent the development of deep vein thrombosis in the decedent.

The plaintiff requests a trial by jury; and seeks judgment against defendant for compensatory damages, costs, and other relief as the court deems just. She is represented by Scott M. Whitley of Morgan & Morgan Tampa PA in St. Petersburg.
