Cable company blamed for injuries to Dunedin resident

CLEARWATER — A Dunedin woman is suing a communication service provider, alleging negligence and breach of duty in installing cable wires that caused the plaintiff to fall.

Mary Davy filed a complaint Jan. 22 in the Pinellas County Circuit Court against Frontier Communications of the South LLC and Frontier Communications of America Inc. alleging the defendant failed to use appropriate care in the installation of a buried cable in a reasonably safe and secure method for its customers.

According to the complaint, on March 30, 2017, Frontier installed communications wire/cable at 1183 Taylor Ave., Dunedin. but left the wire/cable unburied. Davy says she reported the condition of the wire, which ran along the back of her home.

The lawsuit states Davy tripped on the cable while walking out her back door to attend to a garden in her back yard, leading to permanent bodily injuries, disability, loss of enjoyment of life and medical expenses. 

The plaintiff alleges Frontier Communications of America failed to leave any warnings signs or otherwise mark the cable to warn of the hazard created and failed to properly install the cable in a safe and prudent manner.

Davy seeks trial by jury, damages in excess of $15,000, including interest, court costs, attorney fees and all other expenses incurred. She is represented by attorney Travis J. McConnell of St. Petersburg.
