Bert Muller Home owner, caregiver accused of negligence

CLEARWATER — A legal guardian of a disabled adult is suing PARC Inc. and Bonnie D. Burrell, home care company, alleging breach of contract and negligence.

Erin Hunnicutt filed a complaint on Jan. 10 in the Sixth Judicial Circuit Court against the defendants alleging that they breached the professional standard of care and treatment.

According to the complaint, the plaintiff alleges that on Nov. 20, 2017, Erin Hunnicutt's sister, a developmentally disabled adult, suffered multiple physical injuries when she was assaulted by Burrell while under the care of The Bert Muller Home, which is owned by PARC. 

The plaintiff holds PARC andBurrell responsible because the defendants allegedly failed to properly supervise its resident, failed to protect its resident from harm and injury, and failed to ensure proper safeguards to prevent negligent acts.

The plaintiff requests a trial by jury; and seeks judgment against defendants for damages, together with interest and costs, attorney’s fees, and further relief as the court deems just. She is represented by James M. Ragano of Stockham Law Group in Tampa.
