Pinellas Park patient accuses medical practitioners of negligence

CLEARWATER — A Pinellas Park patient is suing medical practitioners, alleging negligence and vicarious liability.

Paul Carten filed a complaint Jan. 9 in Pinellas Circuit Court against Dr. Yves Gabriel, Baycare Medical Group Inc., doing business as Morton Plant Hospital et al,, alleging they failed to exercise standard care and skill required of medical providers and facilities.

According to the complaint, on March 2, 2016, Carten underwent a lower left leg amputation at Morton Plant Hospital in Clearwater. The suit says Carten suffered bodily injury and resulting pain, disability, disfigurement, mental anguish, loss of capacity for the enjoyment of life, and the expense of hospitalization and medical and nursing care, due to the defendants' negligence in the care, skill, and treatment of the plaintiff. 

The plaintiff alleges the defendants failed to recognize Carten had a non-healing post-operative wound, and failed to notify Carten's surgeon about his worsening condition.

Carten seeks trial by jury, judgment in excess of $15,000, plus court costs. He is represented by attorney William Lazenby IV of Greco & Wozniak PA in Tampa.
