CLEARWATER — Two Clearwater homeowners are suing an insurance company, alleging breach of contract.
Pamela and Carey Rowan filed a complaint Jan. 9 in Pinellas Circuit Court against Homeowners Choice Property and Casualty Insurance Company Inc., alleging failure to pay for home damages caused by a hurricane.
According to the complaint, on Sept. 10, 2017, while the Rowans' insurance policy was in full force and effect, their property at 1035 Bay Esplanade, Clearwater, sustained a covered loss as a result of Hurricane Irma. After inspection of the loss, the suit says, the Clearwater property sustained damages that were not acknowledged and paid for by Homeowners Choice. As a result, the Rowans say they have suffered and continue to suffer economic damages resulting from the defendant's breach of the policy.
The plaintiffs allege Homeowners Choice Property and Casualty Insurance obligated the Rowans to retain an attorney for the prosecution of the action, failed to properly adjust the loss and failed to make any further payment of insurance proceeds.
The Rowans seek trial by jury, damages of at least $15,000, plus interest, court costs and attorney fees and expenses. They are represented by attorney Mario L. Enriquez of Ramirez Enriquez PLLC in Coral Gables.
