Orlando homeowner alleges insurance company failed to cover hurricane damages

ORLANDO — An Orlando property owner is suing an insurance company, alleging breach of contract.

Razib Khan filed a complaint Jan. 8 in Orange County Circuit Court against American Integrity Insurance Company of Florida, alleging the defendant repudiated its obligations to the policy owner and denied the benefits of the policy.

According to the complaint, on Sept. 11, 2017, Khan's property at 12756 Gettysburg Circle, Orlando, suffered direct, physical damage. This suit says this was caused by Hurricane Irma, a covered peril due. Khan says severe wind and water entered his house through a storm-created opening in the roof. 

Khan says he submitted a claim to American Integrity seeking coverage under the policy for the damage sustained but he has received only partial payment representing a small fraction of the total loss. 

The plaintiff alleges American Integrity Insurance of Florida has failed and refuses to provide him with coverage, in accordance with the policy, for the remainder of damages.

Khan seeks trial by jury, damages of more than $15,000, judgment for his wrongfully being denied coverage and payment under the policy, plus interest, court costs, attorney fees and all equitable remedies. He is represented by attorney Brandon Arrow of Florida Professional Law Group PLLC in Hollywood, Florida.
