Residents blame Orange County apartment owner for motorcycle theft

ORLANDO — Two residents are suing the owners and operators of an Orange County apartment complex, alleging failure to provide proper security for the property.

Rony H. Wenzel and Jessica M. Spencer filed a complaint Jan. 8 in Orange County Circuit Court against The Paramount of Lake Eola and United Specialty Insurance Company, alleging the defendants failed to exercise reasonable and ordinary care to keep and maintain its premises reasonably safe for the use of its residents.

According to the complaint, on April 9, 2017, Wenzel and Spencer suffered harm and damages when their 2016 Yamaha ZO9 motorcycle and 2017 Yamaha R6 motorcycle were taken from the third floor of the parking garage of the Paramount of Lake Eola. The plaintiffs say the neighborhood surrounding the apartment was a high crime area, that there had been numerous similar criminal acts and thefts perpetrated on both residents and the public and that the defendants should have taken steps to provide proper security. 

The plaintiffs allege the defendants failed to provide appropriate alternatives to keep the parking garage reasonably safe while the gates were not working and failed to implement adequate security policies, security measures and security procedures necessary to protect residents of The Paramount on Lake Eola.

Wenzel and Spencer seek trial by jury, damages of more than $15,000, including prejudged interest, attorney fees and court costs, plus all further relief the court deems just and proper. They are represented by attorney Christopher A. Thorne of Thorne & Associates PA in Orlando.
