Tourist blames Disney restaurant for injuries

ORLANDO — An Indiana tourist is suing a Walt Disney resort, alleging negligence in failing to keep its business premises safe for all guests.

Kathleen Vibbert of Logansport, Indiana, filed a complaint Jan. 8 in Orange County Circuit Court against Walt Disney Parks and Resorts U.S. Inc. alleging the defendant failed to exercise reasonable care for the safety of guests..

According to the complaint, on Jan. 5, 2017, Vibbert visited Walt Disney World's Columbia Harbor House Restaurant to purchase food. While at the restaurant, Vibbert says, she slipped and fell in liquid and ice on the entryway floor. 

As a direct and proximate result, the suit says Vibbert sustained bodily injury, resulting in pain, suffering and expenses of hospitalization. 

The plaintiff alleges Walt Disney Parks and Resorts U.S. failed to maintain or adequately maintain the entryway floor when it allowed liquid and ice to remain where patrons were expected to walk, thus creating a hazardous condition to members of the public utilizing the entryway floor.

Vibbert seeks trial by jury, damages in excess of $15,000, plus interest and court costs. She is represented by attorney James T. Lynch of Morgan & Morgan, PA in Orlando.
