Orlando property owner alleges insurance company failed to cover hurricane damage

ORLANDO — An Orlando property owner is suing an insurance company, alleging breach of contract.

Rosemarie Postles filed a complaint Jan. 8 in Orange County Circuit Court against American Security Insurance Company, alleging failure to render coverage for property damaged in a hurricane as required by Florida law.

According to the complaint, on Sept. 11, 2017, Postles' property at 6025 Powder Post Drive, Orlando, suffered damage from Hurricane Irma that required reasonable, related, and necessary repairs and replacements, as well as appropriate cleaning and other remedial measures. 

Postles says she gave timely notice to American Security of the loss and delivered a full and particular account of expenses and losses as a result of the storm. However, the suit says, Postles failed to receive coverage despite complying with all conditions under the contract. 

The plaintiff alleges American Security Insurance failed to establish it had reasonable proof that it was not responsible for the payment for the damages and loss, and has failed to pay the requested amounts for repairs and/or replacements, plus applicable interest, pursuant to the terms of the insurance policy.

Postles seeks trial by jury, damages of more than $15,000, interest, attorney fees, court costs and all other relief the court deems just and proper. She is represented by attorney Thomas J. Morgan Jr. of Morgan Law Group PA in Coral Gables.
