Orlando property owners allege insurer failed to cover hurricane damage

ORLANDO — Orlando property owners are suing an insurer, alleging breach of contract.

Anthony Lehman and Rita Lehman filed a complaint Jan. 8 in Orange County Circuit Court against American Strategic Insurance Corp., alleging the insurer failed to cover property damage caused by a hurricane.

According to the complaint, on Sept. 10, 2017, the Lehmans suffered damage from Hurricane Irma to their home at 10023 Dean Chase Blvd., Orlando. The suit says the plaintiffs have complied with all conditions precedent to entitle them to recover damages to their dwelling under the policy. However, the lawsuit states, American Strategic has refused to provide coverage for the loss. 

The plaintiffs allege American Strategic Insurance refused to fully perform under the policy and failed to fully pay all the plaintiffs’ losses as required by the policy.

The Lehmans seeks trial by jury, damages of more than $15,000, judgment against the defendant for the plaintiffs’ losses, plus interest on any overdue payments, attorney fees and court costs. They are represented by attorney James J. Dye of Morgan & Morgan PA in Orlando.
