Customer blames Clearwater motorcycle store for fall, injuries

CLEARWATER — A customer is suing a Clearwater motorcycle store, alleging negligence caused the plaintiff to fall and suffer injuries.

Genaro Ortiz filed a complaint Jan. 5 in Pinellas Circuit Court against West Coast Powersports LLC, alleging failure to maintain its premises in a safe condition.

According to the complaint, on Nov. 2, 2017, Ortiz went to the defendant's store on U.S. Highway 19 North in Clearwater to purchase a motorcycle. The suit says Ortiz slipped and fell from the dust and dirt that had accumulated on the floor of the motorcycle store. As a result of the defendant's negligence, Ortiz says he was injured in and about his body and extremities, incurred medical expenses, sustained pain and suffering, and loss of wages. 

The plaintiff alleges West Coast Powersports failed to adequately warn him of the danger of slipping on the dust and dirt, failed to adequately maintain the floor space and failed to adequately correct the dangerous condition.

Ortiz seeks trial by jury, judgment in excess of $15,000, exclusive of interest, court costs and attorney fees. He is represented by attorney Joseph A. Kopacz of Morgan & Morgan Tampa PA in Tampa.
