ORLANDO — A girl's parent is suing a school district over allegations it was negligent in keeping school grounds safe for children.
Milton Zapata, as the parent and natural guardian of Bella Zapata-Chavez, a minor filed a complaint on Jan. 3 in the 9th Judicial Circuit Court of Florida - Orange County against the Orange County School board alleging that it failed its duty to supervise his daughter's school grounds while it was in use.
According to the complaint, the plaintiff alleges that in April 1, 2016 his daughter was injured when she fell from playground equipment at Prairie Lake Elementary School. As a result, Zapata claims her daughter suffered bodily injuries, pain, disability and medical expenses.
The plaintiff holds the Orange County School board responsible because the defendant allegedly failed to provide reasonable or adequate supervision and control of the playground during the times the playground was in use by students.
The plaintiff requests a trial by jury and seeks judgment for damages in excess of $15,000 plus costs and any other relief the court deems appropriate. He is represented by James P. Kelley of James P. Kelley in Orlando.
