CLEARWATER — A customer is suing Fiat, alleging breach of a written warranty in selling a defective car.
Peter Ceferino Roig filed a complaint Jan. 2 in Pinellas Circuit Court against FCA US LLC, alleging the Fiat manufacturer obtained profit through distribution of a defective product.
According to the complaint, on March 3, 2015, Roig paid $22,192.2014 Fiat 500 L. The suit says Roig has been and will continue to be financially damaged due to his purchase of a defective vehicle and Fiat's failure to repair the defects or replace the vehicle. The lawsuit says defects included the engine, transmission and or electrical system evidenced by smoke coming out of the front of the car.
The plaintiff alleges FCA US failed to adequately repair the defects of the Fiat 500 within a reasonable time, and impaired the value, safety and reliability of the car.
Roig seeks trial by jury incidental and consequential damages of at least $15.000, attorney fees, witness fees, court costs, all other fees incurred, and all further relief the court deems just. He is represented by attorney Brent Wikgren of Krohn & Moss Ltd. in Chicago.
