Resident blames Pinellas County senior living facility for injuries

CLEARWATER — A resident is suing a Pinellas County senior living facility, alleging negligence caused her to suffer injuries.

Lorena Rodriguez filed a complaint Dec. 21 in Pinellas Circuit Court against Largo Investments & Associates LLC, doing business as Oak Manor Senior Living Community, alleging failure to maintain its premises in a safe condition.

According to the complaint, on May 8, 2014, Rodriguez fell after a poorly timed sprinkler forced her to leave the pavement and walk on the sod. The suit says Rodriguez sustained bodily injury and resulting pain and suffering, disfigurement, mental anguish, incurred medical expenses, and an aggravation of a previous existing condition. The lawsuit states the defendant's improper setting of its sprinkler heads caused water to accumulate on the walkways, and forced residents like Rodriquez to walk onto unsafe sod surfaces. 

The plaintiff alleges Oak Manor Senior Living Community failed to warn residents of concealed perils, and failed to adequately train its employees in the maintenance of its sprinkler system and sod.

Rodriguez seeks trial by jury, damages of more than $15,000 and all just and proper relief. She is represented by attorney Bruce M. Kleinberg of Jack Bernstein PA in Tampa.
