Orlando property owner alleges insurance company failed to cover wind damage

ORLANDO — An Orlando property owner is suing an insurance company, alleging breach of contract.

Angel Carbonell filed a complaint Dec. 20, in Orange County Circuit Court against American Integrity Insurance Company of Florida, alleging the defendant failed to to provide insurance coverage for damaged property.

According to the complaint,  on Jan. 23, 2017, Carbonell's property at 5424 Ashmeade Road, Orlando, suffered damage due to strong winds. The suit says Carbonell made a timely claim for the damage and loss to the property and has satisfied all post-loss obligation as requested by American Integrity Insurance. 

Despite performing all obligations, Carbonell says, she has failed to receive any amounts due under the insurance policy. 

The plaintiff alleges American Integrity Insurance Company of Florida has failed and refuses to pay the damages despite knowing the loss is covered under the policy, failed to perform all duties properly required under the insurance policy and failed or refused to fully provide coverage under the policy.

Carbonell seeks trial by jury, actual and compensatory damages of more than $15,000, pre-judgment interest, attorney fees, costs of action and all further relief the court deems appropriate. She is represented by attorney Ramon J. Diego of Law Office of Ramon J. Diego PA in Miami.
