ORLANDO — A Duval County woman is suing an Orlando resort owner, alleging negligence caused her injuries.
Samantha Stimpson filed a complaint Dec. 20 in Pinellas Circuit Court against Westgate RVS Orlando LLC, alleging the resort owner failed to to maintain its premises in a safe condition.
According to the complaint, on March 11, 2016, Stimpson was a business invitee of the defendant's Westgate Leisure Resort on Villa De Costa Drive in Orlando. The suit says Stimpson was caused to fall on the stairs due to the dangerous, latent condition of the landing area. As a result of the defendant's negligence, the plaintiff says she sustained bodily injury and resulting pain and suffering, disability, mental anguish, loss of earnings and aggravation of a previous existing condition.
The plaintiff alleges Westgate RVS Orlando failed to conduct appropriate inspections of the stairway, failed to paint the steps with safety markings, and failed to warn Stimpson of the defective condition of the stairway.
Stimpson seeks trial by jury, damages in excess of $15,000, plus court costs. She is represented by attorney Kevin A. Brown of Farah & Farah PA in Winter Park.
