Wife blames Pinellas County nursing home for husband's suffering

Medical malpractice 04

CLEARWATER — A Hillsborough County woman is suing a Pinellas County nursing home, alleging negligence in the treatment of her husband.

Elsa T. Rivers, as agent of her husband William H. Rivers, filed a complaint Dec. 20 in Pinellas Circuit Court against 3865 Tampa Road LLC, doing business as West Bay of Tampa, and West Bay Nursing Center LLC, alleging failure to exercise standard care and skill required of medical facilities.

According to the complaint, starting April 19, 2016, William Rivers, who was older than 60 and suffering from the infirmities of aging became a resident of West Bay of Tampa. The suit says he suffered physical and emotional injuries as a result of the defendants' negligence in the care, treatment and respect for his nursing home rights.

The plaintiff alleges the defendants failed to treat William Rivers courteously and with dignity, failed to provide appropriate care and treatment, and failed to ensure his right to be free from mental and physical abuse.

Elsa Rivers seeks trial by jury, compensatory damages of more than $15,000, plus costs, pre-judgment interest, and all further relief the court deems proper. She is represented by Michael J. Trentalange and Craig M. Harris of Trentalange & Kelley PA in Tampa.
