Couple blames St. Petersburg for wife's fall, injuries

CLEARWATER — A couple is suing St. Petersburg, alleging loss of consortium and negligence.

Michelle and Roy Graham filed a complaint Dec. 18, in the Pinellas Circuit Court against the city of St. Petersburg,  alleging failure to use due care to maintain its premises in a safe condition.

According to the complaint, on Jan. 10, 2016, Michelle Graham was injured when she tripped and fell over a piece of the sidewalk that was uneven, broken and raised near 2843 Ninth Ave. N., St. Petersburg. The suit says the fall caused Graham to sustain bodily injury and resulting pain and suffering, disability, disfigurement, mental anguish, and loss of capacity for the enjoyment of life. 

The lawsuit states Roy Graham has lost his wife's society and services, and incurred medical expenses. 

The plaintiffs alleges the city of St. Petersburg failed to properly warn Michelle Graham of the dangerous condition and failed to inspect, discover and correct the dangerous condition.

The Grahams seek trial by jury, compensatory damages in excess of $15,000, plus interest and court costs. They are represented by attorney Eric J. Paolino of Shocklee & Paolino PA in St. Petersburg.
