Orange County customer accuses homebuilding company of violating Florida Building Code

ORLANDO — An Apopka man is suing a homebuilding company, alleging breach of contract and design defect.

Walter C. Lane filed a complaint Dec. 11 in Orange County Circuit Court against Pulte Home Company, LLC, formerly known as Centex Home  alleging the defendant breached the contract by violating the requirements of the Florida Building Code in constructing a home.

According to the complaint, Lane entered into a contract with Pulte Home to construct a house at 2009 Rafton Road, Apopka. The suit said construction was to be done in accordance with certain plans, specifications on file with Orange County and pursuant to all applicable Florida Building Code provisions. Lane says the house was inadequately and improperly built, violating the Florida Building Code including the applicable ASTM standards. 

The plaintiff alleges Pulte Home failed to construct and deliver a home in compliance with all applicable local, state, and national building codes and regulations, and failed to know that the home violated the Florida Building Code and in contravention of the Florida Building Codes Act.

Lane seeks trial by jury, damages of more than $15,000, plus interest, court costs and all other relief the court deems just and appropriate. He is represented by attorney Joshua M. Zudar of Burnett Wilson Reeder in Tampa.
