Guest blames Clearwater property owner for injuries

CLEARWATER — A Hillsborough County woman is suing a Clearwater property owner, alleging negligence caused her to fall and suffer injuries.

Beverly Anna Morris filed a complaint Sept. 28 in Pinellas County Circuit Court against On Top of the World Communities Inc. alleging the defendant failed to provide a safe environment for its business invitees.

According to the complaint, on Aug. 1, 2016, Morris was on the defendant's property as an invitee when she tripped and fell in the parking lot of the Bavarian Chalet at 2447 Ecuadorian Way, Clearwater. The suit says Morris was injured, suffered pain, incurred medical expenses in the treatment of her injuries, and suffered physical handicap, disfigurement, and mental anguish. 

The plaintiff alleges On Top of the World Communities allowed a defective and dangerous condition to exist for a sufficient length of time, failed to provide adequate lighting in the parking lot, and failed to warn the plaintiff of the dangerous and defective condition.

Morris seeks trial by jury, damages of at least $15,000, plus costs. She is represented by attorney Jessica E. Shahady of The Ruth Law Team in St. Petersburg.
