Orange County couple accuses health care providers of negligence

Medical malpractice 03

ORLANDO — An Orange County couple is suing health care services providers, alleging negligence led to back injuries for the wife.

Vilma Grasso and Joseph Grasso filed a complaint Sept. 29 in the Ninth Judicial Circuit Court in Florida Orange County against Adventist Health System/Sunbelt Inc., doing business as  Florida Hospital, doing business as Florida Hospital Rehabilitation & Sports Medicine Maitland, and RDV Sportplex, alleging failure to exercise professional standard of rendering care and treatment as a therapist.

According to the complaint, on Aug. 18, 2016, Vilma Grasso sustained injuries to her back, specifically fracture of the lumber vertebra, when she fell backward to the floor while performing squats on the half-moon ball, which therapist Karis Zbaraschuk instructed her to do.

As a result, Grasso says she suffered bodily injuries and resulting pain and suffering, disability, disfigurement, mental anguish and incurred medical expenses. Her husband, Joseph Grasso, the suit says, has been deprived of the services, companionship and consortium of his wife.

The plaintiffs allege Zbaraschuk failed to properly instruct and supervise Vilma Grasso in the use of the half-moon ball and failed to appreciate the risk of falling during her session.

The Grassos seek trial by jury, judgment of more than $15,000, court costs and other relief the court deems just. They are represented by attorney Richard W. Bates of Morgan & Morgan PA in Orlando.
