Orlando property owners allege insurer breached contract

ORLANDO — Two Orlando property owners are suing an insurance company, alleging breach of contract.

Maria Martinez and Ross Campbell filed a complaint Sept. 29 in the Ninth Judicial Circuit Court in Florida Orange County against QBE Specialty Insurance Company,  alleging breach of good and fair dealings.

According to the complaint,on Oct. 20, 2012, while the insurance policy issued by QBE in full force and effect, Martinez and Campbell suffered direct physical damage to the walls and floors of their insured dwelling, structure and property at 11717 Sawyer St., Orlando. 

The suit says the plaintiffs have not received the full benefits under the QBE policy. The plaintiffs allege QBE Specialty Insurance has failed and refused to pay all the benefits under the policy.

Martinez and Campbell seek trial by jury, damages, prejudgment interest, cost, attorney fees and all other relief the court deems proper. They are represented by attorney James J. Dye of Morgan & Morgan, PA in Orlando.
