FORT LAUDERDALE — A Fort Lauderdale couple is suing a door and window installation company, alleging breach of contract, fraudulent misrepresentation and negligent installation.
Joseph L. Dombrowski and Edith Dombrowski filed a complaint Oct. 5 in the Broward County Circuit Court against High End Impact Windows & Doors LLC, alleging defendants obtained profit through unfair or deceptive trade or commerce.
According to the complaint, the parties entered into an installation contract April 13, 2016, with High End. The suit says the job to install windows and doors for 15 openings at the plaintiffs home at 2548 Mercedes Drive, Fort Lauderdale, was botched.
The Dombrowskis say they continue to suffer from damages, including costs to correct, replace and repair their windows and doors as a result of High End's misrepresentation of facts and its negligent and defective work.
The plaintiffs allege High End misrepresented themselves to be an authorized dealer and installer of PGT Industries Inc. products, induced the Dombrowskis to enter into a contract and utilize its services, and failed to properly install the windows and doors according to applicable industry standards.
The Dombrowskis seeks trial by jury, all damages of at least $15,000, including actual and compensatory damages, loss of use, diminution of value, costs to repair, court costs, interest, and all other relief deemed just. They are represented by attorney Ian T. Holmes of Holmes Kurnik PA in Naples.
