Employee blames Pinellas County services company for 20-foot fall

CLEARWATER — An employee is suing a Pinellas County services company, alleging negligence caused him to suffer injuries in a fall.

Jacob Perez filed a complaint Sept. 25 in Pinellas County Circuit Court against Jason Mitow and Bartini NWC LLC,, alleging they failed to follow applicable safety guidelines and regulations.

According to the complaint, on Sept. 26, 2013, Perez was instructed by Mitow to paint a property at 35631 U.S. Highway 19 N., Palm Harbor, but was not given proper equipment to do the job safely. 

Consequently, the suit says, the plaintiff fell 20 feet off a ladder to the floor. The suit states Perez was utilizing a ladder that was leaning on a defective structure.

Perez alleges he sustained bodily injuries resulting in pain and suffering, disability, disfigurement, mental anguish, loss of capacity for the enjoyment of life, and aggravation of pre-existing conditions. 

The plaintiff alleges the defendants failed to provide appropriate materials and equipment, safety instructions regarding the premises, and a sufficient amount of time for Perez to plan and prepare his work.

Perez seekd trial by jury, damages of more than $15,000, plus court costs. He is represented by attorney Stephen E. Bailey of Seminole.
