Manufacturer alleges contractor, property owner owe nearly $43,000

FORT LAUDERDALE — A manufacturing business is suing a construction services company and a property owner, alleging breach of contract and unjust enrichment.

Axxium Engineering LLC filed a complaint Sept. 25 in the 17th Judicial Circuit Court of Florida Broward County against Amicon Construction Services Inc. and 8000 West Sunrise LLC, alleging failure to perform their obligations under the terms of an agreement.

According to the complaint, on Dec. 5, 2016, Axxium Engineering performed construction improvements to the property at 7600 W. Sunrise Blvd., Plantation, owned by 8000 West Sunrise, specially the installation of manufactured stainless steel and ornamental work on the staircase in the amount of $44,940. The suit says the balance of $42,620.24 remains due and owing. 

The plaintiff alleges the defendants have failed and refused to pay for the labor, services and materials provided by Axxium and have been unjustly enriched at the expense for the same amount.

Axxium Engineering seeks trial by jury, damages to be determined at trial, cost, prejudgment interest and such other relief this court deems just and proper. It is represented by attorneys Timothy S. Taylor and Felix Ojeda of Taylor Espino Vega and Touron PA in Coral Gables.
