ORLANDO — An Orlando homeowner is suing an insurance company, alleging breach of contract in failing to cover costs for water damage.
Genevieve Lubin filed a complaint Sept. 21 in Orange County Circuit Court against American Integrity Insurance Company of Florida, alleging the insurer breached its duty of good faith and fair dealing.
According to the complaint, on March 7, Lubin's insured property at 1816 Ribbon Falls Parkway, was damaged by a sudden water event. Although, the suit says, Lubin notified American Integrity of the loss and allowed necessary inspections and evaluations of the property, the defendant failed to adequately compensate the plaintiff for reasonable repair costs.
The plaintiff alleges American Integrity Insurance refused to pay the value of repairs needed to return the property to its pre-loss condition, and obligated Lubin to retain and pay for legal counsel.
Lubin seeks trial by jury compensatory damages of at least $15,000, interest, courtcosts and attorney fees. She is represented by attorney Imran Malik of Malik Law PA in Maitland, Florida.
