ORLANDO — An Orlando customer is suing Wal-Mart, alleging negligence caused her to fall and suffer injuries.
Alba Diaz filed a complaint Sept. 21 in the Ninth Judicial Circuit Court in Florida Orange County against Wal-Mart Stores, Inc., alleging negligence in failure to use ordinary care to maintain its premises in a safe condition.
According to the complaint, on Oct. 20, 2013, Diaz experienced serious and permanent injuries when she slipped and fell due to a substance on a floor at the defendant's E Colonial Wal-Mart Supercenter in Orlando. The suit says Diaz has suffered bodily injury resulting in pain and suffering, disability, mental anguish, loss of income and medical and hospital expenses.
The plaintiff alleges Wal-Mart Stores failed to provide training to their employees and the proper maintenance and inspection of the premises to prevent a transitory substance that caused danger to their customers and failed to warn the general public of the concealed dangers in the premises.
Diaz seeks trial by jury, judgment of at least $15,000, and all relief the court deems just and proper. She is represented by attorney Trenton M. Swan of The Pendas Law Firm in Orlando.
