Employee alleges company's negligence led to injuries

CLEARWATER — A Pinellas County man is suing a Clearwater company, alleging negligence led to injuries.

Javier Durazno Cruz filed a complaint Sept. 19 in Pinellas Circuit Court against Sonny Glasbrenner Inc. alleging failure to exercise care and caution for the safety of its workers.

According to the complaint, on March 20, while performing his work duties for the defendant, Cruz's clothing was caught in the exposed belt of a rock crushing machine because the safety guard had been removed by an officer of Sonny Glasbrenner's. The suit says Cruz suffered bodily injury and resulting pain and suffering, disability, disfigurement, multiple surgeries, mental anguish, loss of earnings, and aggravation of a previously existing condition. 

The plaintiff alleges Sonny Glasbrenner failed to implement, monitor and enforce appropriate safety procedures and use of safety equipment, and failed to follow explicit warnings not to remove the safety guard.

Cruz seeks trial by jury, damages, punitive damages, court costs, and prejudgment interest. He is represented by attorney Tomas L. Gacio of Abrahamson & Uiterwyk in Tampa.
