Broward County couple alleges insurer breached contract

FORT LAUDERDALE — A Broward County couple is suing an insurance company, alleging breach of contract.

Luc and Amelia Dominique of Pembroke Pines filed a complaint Sept. 21 in Broward Circuit Court against Federated National Insurance Company, alleging the insurer breached its duty of good faith and fair dealing.

According to the complaint, on April 14, while the Dominiques' property at 9801 NW 20th St., Pembroke Pines was actively insured, it sustained a covered loss for water damage, including damage to the building, contents, and loss of use of the property and possessions therein. However, the suit says, despite efforts by the plaintiffs to timely submit all necessary proof of loss forms, Federated has failed to fully compensate them for all covered losses. 

The plaintiffs allege Federated National failed to pay for all covered losses sustained by a covered peril, and forced the plaintiffs to retain and pay for the services of legal counsel to represent and protect their interest.

The Dominiques seek trial by jury, judgment of more than $15,000, including all general, compensatory and consequential damages, interest, costs, attorney fees and all relief the court deems just. They are represented by attorney Scott Klotzman of Law Offices of Scott Klotzman PA in Hollywood.
