Walt Disney Parks and Resorts US Inc. accused of negligence

ORLANDO — Two individuals are suing Walt Disney Parks and Resorts US Inc. d/b/a Epcot for alleged negligence.

Barry A. Lagler and Suzanne T. Lagler filed a complaint on Aug. 18 in the Orange County Circuit Court, alleging that the defendant failed to provide a safe environment for its patrons.

According to the complaint, the plaintiffs allege that they and their family were on the defendant's premises on Aug. 19, 2013 when Barry A. Lagler allegedly struck the ground with considerable force as he exited a ride, incurring serious bodily injuries, scarring, pain, suffering, disability, disfigurement, mental anguish and loss of earnings. Additionally, Suzanne T. Lagler claims that she has suffered the loss of her husband's consortium, companionship and services. 

The plaintiffs hold the defendant responsible for allegedly failing to provide adequate guardrails, railings and partitions, and for allegedly failing to post signs to adequately warn passengers of the danger.

The plaintiffs request a trial by jury and seek judgment against the defendant for damages, along with pre-judgment interest on liquidated sums, costs of action and other relief deemed appropriate by the court. They are represented by T. Scott Frazier of Terry & Frazier PA in Orlando.
