ORLANDO — An individual is suing Dr. Julio Hajdenberg and Orlando Health Physician Inc. for alleged negligence and liability.
Daniel Smithwick, personal administrator of the estate of Faye Smithwick, filed a complaint on Aug. 17 in the Orange County Circuit Court, alleging that the defendants failed to exercise the standard of care and skill required of medical providers and facilities.
According to the complaint, the plaintiff alleges that he has suffered from the loss of the decedent's companionship and protection, mental pain and suffering and incurred funeral expenses. He claims that his suffering is due to the defendants' negligent medical care and treatment provided to his spouse, which allegedly resulted in her death.
The plaintiff holds the defendants responsible for allegedly failing to adequately monitor and diagnose the decedent's condition, and for allegedly failing to ensure timely and proper medical care.
The plaintiff requests a trial by jury and seeks judgment against the defendants for damages, costs and pre-judgment interest. He is represented by J. Clancey Bounds of Bounds Law Group in Maitland.
