ORLANDO — A dental clinic is suing the Phoenix Insurance Company for alleged breach of contract.
David L. Goldstein DMD PA filed a complaint on Aug. 16 in the Orange County Circuit Court, alleging that the insurance carrier breached its duty of good faith and fair dealing.
According to the complaint, the plaintiff alleges that its property suffered water damage on May 2, 2016. Though the plaintiff allegedly reported the loss to the defendant and requested payment for damages, the defendant allegedly refused to pay any part of the claim.
The plaintiff holds the defendant responsible for allegedly failing to properly investigate the loss and for allegedly refusing to provide coverage for the loss.
The plaintiff requests a trial by jury and seeks judgment against the defendant for contractual and compensatory damages, interest, costs of action, attorney's fees and any further relief the court deems appropriate. They are represented by Matthew R. Danahy of Danahy & Murray PA in Tampa.
