People's Trust Insurance Company accused of breaching contract

FORT LAUDERDALE — An individual is suing People's Trust Insurance Company for alleged breach of contract.

Barry Levan filed a complaint on Aug. 3 in the Broward County Circuit Court, alleging that the insurer breached its duty of good faith and fair dealing.

According to the complaint, the plaintiff alleges that his property sustained water damage on or about March 13, which allegedly required repairs, replacements, cleaning and other remedial measures. Though the plaintiff allegedly provided timely notice of the covered loss, the defendant allegedly denied insurance coverage. 

The plaintiff holds the defendant responsible for allegedly failing to acknowledge coverage for the loss, acknowledge that payment would be forthcoming and for allegedly failing to pay his claim.

The plaintiff requests a trial by jury and seeks judgment against the defendant for damages, plus interest, court costs, attorney's fees and any further relief the court deems just. He is represented by David Low of David Low & Associates PA in Fort Lauderdale.
