FORT LAUDERDALE — An assignee is suing Universal Property & Casualty Insurance Company for alleged breach of contract.
Arthur J. Owens filed a complaint on Aug. 3 in the Broward County Circuit Court, alleging that the insurance carrier breached its duty of good faith and fair dealing.
According to the complaint, the plaintiff alleges that his assignor's property sustained a covered loss on March 20 as a result of a water leak. Though the plaintiff allegedly provided timely notice of the loss, the defendant allegedly refused to pay his insurance claim.
The plaintiff holds the defendant responsible for allegedly forcing him to retain and pay for the services of a legal counsel to represent and protect his interests, and for allegedly refusing to pay the full amount of his insurance claim.
The plaintiff requests a trial by jury and seeks judgment against the defendant for damages, attorney's fees, interest, costs and other relief that the court deems just. He is represented by Erik D. Diener of The Diener Firm PA in Plantation.
