FORT LAUDERDALE — Two individuals are suing Southern Oak insurance Company for alleged breach of contract.
Nidia Z. Munoz and Adan R. Severino filed a complaint on Aug. 2 in the Broward County Circuit Court, alleging that the insurer breached its duty of good faith and fair dealing.
According to the complaint, the plaintiffs allege that their residential property suffered damages on March 18 caused by a broken pipe in the kitchen. Though the plaintiffs allegedly provided the defendant with timely notice of the loss, the defendant allegedly has yet to pay either part or all of their claim.
The plaintiffs hold the defendant responsible for allegedly requiring the plaintiffs to hire legal counsel, and for allegedly breaching its duty by allegedly failing to pay their insurance claim.
The plaintiffs request a trial by jury and seek judgment against the defendant for damages, including consequential damages, costs, interest, attorney's fees and other relief deemed proper by the court. They are represented by Jose I. Garillo of Gimenez & Carillo LLC in Miami.
