ORLANDO — An estate representative is suing Health Services of Ocoee LLC d/b/a Lake Bennett Health and Rehabilitation, Sidney Gallagher a/k/a Duane Gallagher and 1876 Trade Center Way LLC for alleged negligence.

Mildred L. Eason, personal representative of the estate of Ophelia S. Loman, filed a complaint on Aug. 8 in the Orange County Circuit Court, alleging that the defendants failed to exercise the standards of care and skill required of medical providers.

According to the complaint, the plaintiff alleges that Loman suffered extreme pain, suffering and an untimely death. The plaintiff also claims that Loman's surviving heirs allegedly have suffered funeral expenses, mental anguish and the loss of Loman's love, comfort, guidance and companionship allegedly as a result of the defendants' alleged violations of resident's rights, negligence and poor care. 

The plaintiff holds the defendants responsible for allegedly failing to provide the necessary care and services to its residents, keep accurate, complete and organized clinical records of residents and for allegedly failing to ensure that the resident received accurate assessments by a qualified health professional.

The plaintiff requests a trial by jury and seeks judgment against the defendants for damages, plus interest, attorney's fees and costs. She is represented by Garry J. Rhoden of Colling Gilbert Wright & Carter LLC in Orlando.
