The Home Depot USA Inc. allegedly failed to prevent individual from tripping on plastic wrap

ORLANDO — An individual is suing The Home Depot USA Inc. for alleged negligence.

Jesus Sanchez filed a complaint on Aug. 3 in the Orange County Circuit Court, alleging that the defendant failed to provide a safe environment for its patrons.

According to the complaint, the plaintiff alleges that he was lawfully on the defendant's premises on or about Nov. 11, 2016 when he tripped and fell on plastic wrapping that allegedly had been allowed to remain on the floor of the store's aisle. As a result of the defendant's alleged negligence, the plaintiff allegedly was injured and suffered damages. 

The plaintiff holds the defendant responsible for allegedly failing to adequately warn him of the dangerous conditions of the area, and for allegedly failing to properly inspect and maintain the area where the accident occurred.

The plaintiff requests a trial by jury and seeks judgment against the defendant for damages, costs and any further relief the court deems necessary. He is represented by Daniel P. Osterndorf of Pardy & Rodriguez PA in Orlando.
