Southern Fidelity Insurance Company accused of breaching insurance contract

FORT LAUDERDALE — Two individuals are suing Southern Fidelity Insurance Company for allegedly breaching an insurance contract.

Gary and Debbie Millwood filed a complaint on Aug. 2 in the Broward County Circuit Court, alleging that the defendant breached its duty of good faith and fair dealing.

According to the complaint, the plaintiffs allege that their property sustained a direct physical loss on May 5, 2016 due to an accidental discharge of water. Though the defendant allegedly paid policy benefits, the amount paid allegedly is inadequate to perform the necessary repairs to the plaintiffs' property.

The plaintiffs hold the defendant responsible for allegedly refusing to pay additional insurance policy benefits, and for allegedly obligating the plaintiffs to retain and pay for the services of a legal counsel to represent and protect their interests.

The plaintiffs request a trial by jury and seek judgment against the defendant for compensatory damages, interest, attorney's fees, costs and any further relief the court deems just. They are represented by Jeremy Tyler, W. Wyndham Geyer Jr., Andrew Fuxa and Hillary B. Cassel of Geyer Fuxa Tyler in Sunrise.
