Citizens Property Insurance Corporation accused of breaching insurance contract

FORT LAUDERDALE — An individual is suing Citizens Property Insurance Corporation for alleged breach of contract.

Ana Fernandez filed a complaint on Aug. 2 in the Broward County Circuit Court, alleging that the defendant breached its duty of good faith and fair dealing.

According to the complaint, the plaintiff alleges that her property sustained substantial water damages on or about June 7. The defendant, however, allegedly has failed to pay the full insurance benefits the plaintiff claims are due and owing. 

The plaintiff holds the defendant responsible for allegedly failing to extend coverage for the loss, pay the full amount of the benefits and for allegedly forcing her to retain and pay for legal counsel.

The plaintiff requests a trial by jury and seeks judgment against the defendant for damages, attorney's fees, costs and interest. She is represented by Jay M. Arnesen and Paris R. Webb of Arnesen Webb PA in Boca Raton.
