ORLANDO — Two individuals are suing Tower Hill Select insurance Company for alleged breach of an insurance contract.
Thomas and Kelly Gallagher filed a complaint on Aug. 1 in the Orange County Circuit Court, alleging that the insurance carrier breached its duty of good faith and fair dealing.
According to the complaint, the plaintiffs allege that hail and wind damaged their property on June 10, 2016. However, the defendant allegedly has denied coverage for the loss, arguing that the loss allegedly was not covered under the terms of the policy.
The plaintiffs hold the defendant responsible for allegedly obligating them to retain an attorney, failing to acknowledge coverage for the loss, failing to acknowledge that payment would be forthcoming, and for allegedly failing to make any payments to cover the loss.
The plaintiffs request a trial by jury and seek judgment against the defendant for damages plus interest, court costs, attorney’s fees and any other relief the court deems just. They are represented by David Low of David Low & Associates PA in Fort Lauderdale.
