Whole Foods Market accused of failing to prevent individual from falling

ORLANDO — An individual is suing Whole Foods Market IP LP for alleged negligence.

Michelle Hawkins filed a complaint on Aug. 1 in the Orange County Circuit Court, alleging that the defendant failed to provide a safe environment for its patrons.

According to the complaint, the plaintiff alleges that she visited the defendant’s premises on June 15, 2016 to get dinner when she slipped and fell on a slick substance on the floor, allegedly sustaining injuries, pain and suffering, disability, disfigurement, significant scarring, mental anguish and the aggravation of a pre-existing condition. 

The plaintiff holds the defendant responsible for allegedly failing to adequately maintain and inspect its flooring, adequately warn her of the danger posed by the substance on the floor and correct the dangerous condition on its premises.

The plaintiff requests a trial by jury and seeks judgment against the defendant for damages in excess of $15,000 plus interest and court costs. She is represented by James T. Lynch of Morgan & Morgan PA in Orlando.
