CLEARWATER — An individual is suing MCN Group Inc. d/b/a Mainlands of Tamarac by the Gulf for alleged negligence.
Joann Castro filed a complaint on Aug. 9 in the Pinellas County Circuit Court, alleging that the defendant failed to follow applicable safety guidelines and regulations.
According to the complaint, the plaintiff alleges that she was walking her dog on the defendant's property on Jan. 24 when she allegedly stepped off a curb into an unseen drainage culvert, causing her to fall and sustain severe injuries, pain and anguish, incur medical expenses and prevent her from attending to her usual duties and affairs.
The plaintiff holds the defendants responsible for allegedly failing to properly operate, manage, maintain and control the premises, adequately mark the drainage culverts, illuminate the surrounding area and warn her of the dangerous condition on the premises.
The plaintiff requests a trial by jury and seeks judgment against the defendant for damages in excess of $15,000 plus costs, interest and further relief the court may deem proper. She is represented by Jeremy S. Clark of Clark Law in St. Petersburg.
