CLEARWATER — An individual is suing Thirsty Marlin Inc. for alleged negligence.
Kathy Tozzi filed a complaint on Aug. 8 in the Pinellas County Circuit Court, alleging that the defendant failed to provide a safe environment for its patrons.
According to the complaint, the plaintiff alleges that she was at the defendant's restaurant on Dec. 18, 2016 when she stepped off the side of a ramp on the main walkway, which allegedly caused her to fall. As a result, the plaintiff claims that she suffered bodily injury, physical pain and suffering, disability, inconvenience and the aggravation of a pre-existing condition.
The plaintiff holds the defendant responsible for allegedly failing to maintain the walkway in a safe condition, and for allegedly failing to warn herf of the dangerous conditions.
The plaintiff requests a trial by jury and seeks judgment against the defendant for more than $15,000, plus costs and other relief to which she may be entitled. She is represented by David D. Neiser and Matthew A. Dolman of Dolman Law Group in St. Petersburg.
