Homeowners Choice Property & Casualty Insurance Company accused of breaching insurance contract

FORT LAUDERDALE — An individual is suing Homeowners Choice Property & Casualty Insurance Company Inc. for alleged breach of contract.

Maria Mata filed a complaint on Aug. 1 in the Broward County Circuit Court, alleging that the defendant breached its duty of good faith and fair dealing.

According to the complaint, the plaintiff alleges that her property suffered damages due to a water loss. However, the defendant allegedly denied coverage and refused to pay the full amount of her claim. 

The plaintiff holds the defendant responsible for allegedly obligating her to retain and pay for legal counsel to represent and protect her interests, and for allegedly refusing to pay the full amount of her insurance claim.

The plaintiff requests a trial by jury and seeks judgment against the defendant for damages, interest, attorney's fees, costs of action and other relief the court deems just. She is represented by Peter Mineo Jr. of the Mineo Salcedo Law Firm PA in Davie.
