American Security Insurance Company accused of breaching contract for allegedly not paying for water damage

FORT LAUDERDALE — An individual is suing American Security Insurance Company for alleged breach of contract.

Lucille Viviens filed a complaint on Aug. 1 in the Broward County Circuit Court, alleging that the insurer breached its duty of good faith and fair dealing.

According to the complaint, the plaintiff alleges that while her property sustained a covered loss due to water damage. Though the plaintiff allegedly filed a timely notice of the damages, the defendant allegedly has yet to pay either part or all of her claim. 

The plaintiff holds the defendant responsible for allegedly failing to pay all benefits owed to the plaintiff, comply with the terms of the insurance policy and for allegedly requiring the plaintiff to retain the services of an attorney to protect her interests.

The plaintiff requests a trial by jury and seeks judgment against the defendant, determine her rights under the policy, attorney's fees, pre-judgment interest, costs and other relief deemed just. She is represented by Peter Mineo Jr. of the Mineo Salcedo Law Firm PA in Davie.
