ORLANDO — A Florida company is suing River Dog Express LLC and David R. Mara for alleged breach of a lease agreement.
Florida Utility Trailers Inc. filed a complaint on July 21, in the Orange County Circuit Court, alleging that the defendants breached their duty of good faith and fair dealing.
According to the complaint, the plaintiff alleges that it suffered economic damages from leasing a semi-trailer to the defendants, who allegedly failed to pay past due lease payments and repair damages for the rented trailer pursuant to the lease agreement.
The plaintiff holds the defendants responsible for allegedly receiving the benefit of using the semi-trailer without full payment of the lease, and for allegedly requiring the plaintiff to retain and pay for legal counsel.
The plaintiff requests a trial by jury and seeks judgment against the defendants for damages, interest, costs and attorney's fees. The plaintiff is represented by John S. Schoene of John S. Schoene PA in Maitland.
